The Chicago-Kent Intellectual Property Law Society invites you to a panel discussion on this topic given by some of the leading lawyers that deal with these issues every day. Chicago-Kent IPLS in conjunction with the Chicago Bar Association is hosting the third annual patent wars event. CLE will be offered to attorneys. Event Description:  This year’s event will be an exploration of the impact that NPEs have had on the patent litigation landscape as well as a look into some pending legislation and the impact it will have on the future practice of patent law.

Speaker Bios

David Schwartz

Professor Schwartz teaches patent law, patent litigation and intellectual property strategies classes at IIT Chicago-Kent. In 2012, Professor Schwartz received the Excellence in Teaching Award from IIT. Prior to entering academics in 2006, Professor Schwartz practiced intellectual property law, focusing on patents and patent litigation, for over a decade. From 2000 to 2006, he was a partner at two intellectual property boutique firms in Chicago, where his practice included patent, copyright, trademark and trade secrets litigation; patent and trademark prosecution; and intellectual property-related transactions. He began his career in 1995 as an associate at Jenner & Block.

Professor Schwartz’s research focuses on empirical studies of patent law and judicial behavior, including of the use contingent fee representation in patent litigation; reversal rates in patent claim construction cases; litigation involving non-practicing entities; the effect of the presumption of validity on jurors; and the doctrine of equivalents. He has also studied the use of legal scholarship by the judiciary. His scholarship has appeared in leading law journals such as the Cornell Law Review, the Harvard Journal of Law & Technology, theMichigan Law Review, and the Northwestern Law Review.

Gary Cunningham

Gary Cunningham is a Senior Counsel at Motorola Mobility LLC with over twenty years of experience in IP creation, licensing, litigation and complex transactions. In his present assignment, his practice is focused on creating and building an IP portfolio in connection with the wireless communication field, and particularly in power management and design enabling technologies. He leads and teams with clients to drive innovation by directed inventing in key areas of technology.

Previously, Mr. Cunningham was the lead IP in business counselor for a business unit now at Motorola Solutions, Inc. His responsibilities included strategy development, planning and teaming with business leaders to achieve their objectives through IP leveraging, licensing and litigation. He was also lead IP counsel for a number of divestitures and technology incubators. Mr. Cunningham is a recipient of Motorola’s Office of General Counsel Award for Professional Excellence.

David Donoghue

R. David Donoghue is a trial attorney and the deputy practice group leader of Holland & Knight’s Intellectual Property Group, focusing his 15 years of experience upon intellectual property litigation and particularly upon patent disputes. Mr. Donoghue’s most recent trial experience includes a jury verdict finding of willfulness, a full trebling of damages and a full award of attorney’s fees in the Northern District of Illinois. Mr. Donoghue has also been chosen as lead trial counsel in RPXIS’s insurance program defending companies against non-practicing entities.

Mr. Donoghue was previously with Delphi, the world’s largest automotive supplier, where he was a founding member of Delphi’s Technology Licensing and Litigation Group and handled substantial international intellectual property litigation and licensing matters.

Mr. Donoghue has served as an adjunct professor at the Loyola University Chicago School of Law, teaching legal research and writing and intellectual property courses. At the beginning of his legal career, Mr. Donoghue served as a law clerk to the Honorable Gordon J. Quist, federal district judge for the U.S. District Court for the Western District of Michigan.

Matthew McAndrews

Matthew G. McAndrews is a Partner of Niro, Haller & Niro in Chicago. Mr. McAndrews has a broad base of experience in intellectual property, technology licensing and Internet/information law with a concentration in trial and appellate practice. He has represented dozens of clients in intellectual property matters involving such diverse technologies as wireless networking systems, electronic gaming systems, medical imaging systems, spinal implants, dental implants, diabetes infusion devices, safety syringes, healthcare mobility devices, healthcare and medical information systems, Internet messaging and communication systems, power management and distribution systems, and cordless power tools, among others. In the medical technology, Internet communication, and wireless networking fields alone, Mr. McAndrews has recently negotiated licenses and settlement agreements for his clients resulting in tens of millions of dollars in recoveries.

Mr. McAndrews was honored among the Law Bulletin Publishing Company’s “40 Illinois Attorneys Under 40 to Watch” in 2005. He is frequently interviewed by national publications, including the The Wall Street Journal and Law360. Locally, The Chicago Daily Law Bulletin covers Mr. McAndrews’ cases and Chicago Lawyer Magazine published a feature article on him in its April 2013 edition. He is a member of the bars of several federal district and appellate courts, including the Trial Bar of the Northern District of Illinois, and has a near-perfect record on appeal to the United States Court of Appeals for the Federal Circuit. Mr. McAndrews has also practiced in the Supreme Court of the United States.

Mr. McAndrews graduated from the University of Notre Dame in 1989 with a degree in Economics and received his law degree from The John Marshall Law School in 1995. He and his wife, Beth, are raising their four daughters in Northwest Suburban Chicago.
