Should a worker be compelled to pay union fees even if he does not wish to be part of a public sector union? On one hand, the union is representing his rights and the worker is benefiting from its negotiations with the employer. On the other, the First Amendment’s freedom of association and speech clauses may prevent the government from forcing individuals to be apart of a private organization. The U.S. Supreme Court will hear the question in Janus v. AFSCME.
