CPR Webinar – Forced Arbitration, Workers, and Marginalized Communities – Tuesday, Feb 15

The next time you take a job, sign a lease, buy a product or service, receive health care, or move a relative into a nursing home, take a close look at the contract. The fine print likely requires you to file any legal claims in a rigged system of arbitration rather than an impartial court of law — tilting the outcome against you before the process even starts.

The use of these clauses is widespread and growing — and dismantling our system of justice right under our noses.

Who pays the highest price? Those of us who are already disadvantaged due to racism, sexism, classism, ageism, structural discrimination, and other systems of oppression.

In a new report, the Center for Progressive Reform shines a light on the especially pernicious effects of forced arbitration clauses on people of color, women, low-income people, residents of nursing homes, and other historically marginalized groups. Entitled Private Courts, Biased Outcomes, the report is the first to examine how this practice favors corporations over marginalized workers and consumers — robbing them of their right to seek justice.

What’s the solution? It’s not “buyer beware.” It’s structural legal reform.

Our report could not be more timely. On Monday, the House passed the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act. The bill now heads to the Senate, where it has bipartisan support and could come up for a vote within days. Our report explains why legislation like this is so important.

We must restore our right to hold corporations accountable in the courts and revive civil justice — aka, the “great equalizer.” If we don’t, equity for all will fall farther out of reach.

Join our campaign for workers’ and consumers’ rights for all.

Read the report. Register for our February 15 webinar co-hosted with the Workers’ Rights Institute at Georgetown Law, and subscribe to our email list. And be sure to like and share on Twitter, Facebook, LinkedIn, and Instagram.

Join us for justice!

4. Gina Dvorak: Unite Here Local 23 Organizer

The onset of the COVID pandemic in 2020 and its devastating effects on working people have exacerbated existing tensions between workers and employers, with stagnant wages and growing corporate profits continuing to stratify haves and have-nots. In turn, labor unions are now looked on with the most favorability they have enjoyed since 1965, with two-thirds of the U.S. population’s approval. As recent as October 2021, media outlets and many unions used #Striketober and the “Great Resignation” to describe a large number of strikes, walkouts, and collective actions at John Deere, Kellogg, and many other employers across the country. In this panel, we will examine how the pandemic has changed the dynamics of labor organizing, the future of labor movements in right-to-work states like Texas, and the role of labor lawyers in this dynamic and urgent fight for workers’ rights.

Important Dates to Remember

Black History Month – February

Each February, Black History Month honors the struggles and triumphs of millions of American citizens over the most devastating obstacles — slavery, prejudice, poverty — as well as their contributions to the nation’s cultural and political life. According to the U.S. Census Bureau, African Americans make up about 14 percent of the U.S. population.

National African American History Month was the inspiration of Carter G. Woodson, a noted scholar, and historian, who instituted Negro History Week in 1926. He chose the second week of February to coincide with the birthdays of President Abraham Lincoln and the abolitionist Frederick Douglass. The celebration was expanded to a month in 1976, the nation’s bicentennial. President Gerald R. Ford urged Americans to“seize the opportunity to honor the too-often neglected accomplishments of [B]lack Americans in every area of endeavor throughout our history.”

To learn more we suggest visiting the DuSable Museum, the first independent museum celebrating Black culture, here in Chicago.

Muslim Law Student Association (MLSA): The Muslim Law Student Association (MLSA) at Chicago-Kent needs your help. For years, Muslim students have led conversations about the exclusion of Islamic holidays on our academic calendar. Islam, Christianity, and Judaism make up the Abrahamic religions and are statistically the three most-followed faiths in the US. However, Islam is the only Abrahamic religion excluded from Chicago-Kent’s academic calendar. 1.8 billion Muslims across the world celebrate Eid Al-Fitr and Eid Al-Adha, the two main holidays in Islam. While Chicago-Kent does offer Muslim students accommodations for Eid, these accommodations are neither realistic nor satisfactory. Each year, Muslim students are forced to choose between celebrating their holidays with family and friends, or attending lectures, events, and essential class discussion, ultimately compromising either their religious observances or law studies.

For this reason, MLSA is requesting your support by signing a petition to present to our school’s administration, highlighting the importance of and our community’s solidarity for this cause. Chicago-Kent is a law school committed to advancing diversity and inclusion, and resolving this issue is a necessary step toward that mission. Please sign this petition to show your support, and consider sending this petition to any current Chicago-Kent student. Thank you for your support. Peace and Blessings.

Join the First-Generation Law Student Association on Jan 21, 2022 at 6pm via zoom for a conversation with faculty, career services, and students to discuss grades, what they may or may not mean for future employment, and how to continue succeeding or tackle improving. Professor Adrian Walters will provide a perspective as a teacher of 1L core courses, Dawn Young will provide resources, Vicki Ryan of Career Services will discuss job options and prospects, and upper-level students will provide perspectives on their own experiences. Whether you did well or poorly, there are options and opportunities for continued growth and improvement, and we can help with guidance and support. Please RSVP here for the event. The Zoom link is available here and on the SBA calendar, and you will receive a calendar invitation after you RSVP.

December 5, 2021

Announcements

Winter 2022 – Holiday Highlights Form: The Student Bar Association and Student Diversity Council would like to share some personal highlights and traditions from our student body as we head into the Winter break and many are celebrating at this time of year.

Do you have something you’ve enjoyed or are looking forward to that you’d like to share?

Complete this form to send photos and/or notes as we put together something fun to share with students at the end of the Fall 2021 semester. You’ll get an email confirmation when you complete the form.

Student Tech Survey – Extended Access: The Chicago-Kent Tech team would like to thank the students who have responded to the Fall 2021 Tech Survey and wish you all the best with your exams this semester. To include as many students as possible, we’ve extended access to the survey through Tuesday, 12/7 – it should only take a few minutes to submit and is completely anonymous (though you need to use your kentlaw email to validate your student status).

  • Survey link: helpdesk account, which includes our IT, audiovisual, and digital education support staff. The survey won’t allow individual responses.

Study Resources for 1Ls (and everyone!): Hello, 1Ls! Congratulations on completing your first Fall semester of law school! I know, I know. You’re thinking: but it isn’t over yet, there are exams! You are correct. However, you’ve endured an entire semester of taking multiple law school classes. Be proud of yourself! The fact that you are still here (and reading this) speaks volumes! You can do it!

As we head into the days before finals affectionately known as “read period,” SBA wanted to make you aware of the following resources that may help in your final exam preparation. Most of these resources are FREE to you as a law student.

    1) West Academic Study Aids – As law students, we have FREE unlimited access to West’s database of academic supplements. This includes popular series books like “In a Nutshell,” “Quick and Happy Guides,” “Sum and Substance,” and MORE. Think of it as a bunch of free electronic supplements on every law school subject you can think of! You can access it through the Library’s Electronic Resources > Databases page through Kent’s website. Just login with your Kent IIT username and password! You don’t need to make an account, but you can easily make a FREE account with your Kent email. This allows you to create a list of favorites, bookmark and highlight books. They also have apps for both the books and the audio lectures, and once you create an account, you can download anything and access it directly from the app. Studying with free supplements has never been easier! Check it out HERE.

    2) CALI (Computer Assisted Legal Instruction) – CALI not only sponsors those coveted “top score” awards you see listed in the Record after semester grades are issued, but also offers TONS of free interactive lessons FILLED with those hypotheticals our law professors love. Hypotheticals are a great way to practically apply the law you’ve been learning all semester to a set of facts, with feedback! They also offer podcasts on law school subjects, so you can study anywhere – the train, in an Uber, while working out, grocery shopping, walking your dog…just about anywhere you can listen to a podcast! CALI information is typically provided to students at the beginning of the semester, however, feel free to email refreq or stop at the service desk in the library for Kent’s school access code. The link to the database is HERE.

    3) Chicago-Kent’s Exam Database – One of the greatest resources for knowing what to expect on a law school exam: looking at previous exams! Many (but not all) of Chicago-Kent’s courses and professors provide previously-issued exams (and often, answer keys) for students to use as a study tool. Professors may also provide their old exams on Blackboard, a personal website, TWEN, or through a Teaching Assistant. Taking an old exam under simulated, timed testing conditions is an excellent way to prepare yourself for the real thing day-of! Find the Chicago-Kent exam database HERE.

    4) BARBRI 1L Mastery – BARBRI isn’t just for the bar exam…they also offer an excellent, FREE 1L Mastery program covering all required 1L courses: Civil Procedure, Constitutional Law, Contracts, Criminal Law, Real Property, and Torts. The program includes incredibly detailed, comprehensive outlines for each of these courses, downloadable for free online. Your friendly neighborhood BARBRI representatives may even have extra printed copies of these outlines if you prefer paper – don’t be afraid to reach out and ask! Sign up for the FREE 1L Mastery resources HERE.

    5) Quimbee – There’s a reason so many law students rely on Quimbee for their go-to supplement database. Quimbee is a one-of-a-kind educational resource providing a comprehensive database of law school study aids, including case briefs, case videos, outlines, flashcards, quizzes, video courses, practice essay exams, key terms, multiple choice questions, and more. There’s both a website and an app component, so you can study anywhere! Quimbee isn’t free (unfortunately), but the cost varies on subscription tiers and timing. (We recommend the Gold membership purchased annually to get the most bang for your buck!) Quimbee offers a 7-day free trial through their website. Alternatively, as a law student, if you sign up for a free ABA law student membership, you can get a FREE 30-day Gold membership to Quimbee – just in time for exam season! Access this great deal HERE.

SBA is cheering you on and hopes this list of resources serves you well in the upcoming weeks.

You’ve got this! SBA (and Magic Cat) believe in you!

Description

Month of November, Native American Heritage Month/Indigenous People’s Month

Native American Heritage Month was originally celebrated as a week-long celebration in 1986. Since then, every US President has issued annual proclamations designating November as a time to celebrate the culture, accomplishments, and contributions of people who were the first inhabitants of North America.

The Chicago area is located on ancestral lands of indigenous tribes such as the Council of the Three Fires, comprised of the Ojibwe, Odawa, and Potawatomi nations; the Miami; Ho-Chunk; Menominee; Sac; Fox; Kickapoo; and Illinois Nations. To learn more, see the resources linked below:

Barristers’ Ball Survey! We are very excited to announce that the Barristers’ Ball is a GO this year! For those who do not know, the Barristers’ Ball is an annual event held at most law schools towards the end of the school year. The event is hosted by SBA as a school-wide formal affair- you might have heard it referred to as "Law School Prom." This year is very special, especially to all of the 3Ls, since this event has been canceled for the past two years. That being said, we want to make this year’s Barristers’ the biggest celebration it can be while ensuring it is as safe as possible for every student in attendance. We all deserve a special night to celebrate our accomplishments throughout this crazy covid law school experience we have all had. If you could take a minute and complete this survey so the Barristers’ Committee can plan as carefully as possible, I know we would all greatly appreciate it. Thanks and see you all at Barristers’!

Fall Clothing Drive, now through 11/30/2021 (note the changed date): Parents and Caregivers at Chicago-Kent (PACCK), The Chicago-Kent Racial Equity and Advocacy Alliance (REAA), and Women in Law (WIL)—in partnership with the Design Museum of Chicago—are pleased to sponsor a Fall Clothing and Toy Drive to benefit The Women’s Treatment Center (TWTC) in Chicago. TWTC served as the sole substance abuse treatment center in Illinois focused solely on women and specializing in treatment framed and informed by women’s issues. However, the pandemic forced TWTC to shutter its physical space, and many women were displaced. While TWTC has found new arrangements for many of the women and children it serves, these women and their children remain in need of clothing in general—and toys (!) for this upcoming holiday season. PACCK, REAA, and WIL ask you to open your hearts (and your closets!) and donate this fall to support these women and their families as they transition through recovery. The Design Museum will accept donations now through November 30, 2021. You may donate via drop-off, delivery, or mail, directly to:

Learn how they shaped their careers, the movements they have been a part of, and their advice for law students now. From Standing Rock to Guantanamo there is a role for lawyers to play in resisting the system and building solidarity with radical peoples movements at every stage of our careers. Come learn from those who have gone before and are still paving the way! This is an opportunity for students to come and ask practicing attorney’s questions about movement lawyering, and social justice lawyering in today’s landscape. Bring your lunch and your questions!

Where: Room 704 or on zoom: https://bit.ly/3kmuBb4

When: Tuesday, Nov. 23, 12:30-2

Candace Gorman:Gorman has won a unanimous decision before the United States Supreme Court, taken on pro bono habeas corpus petitions for two men being held at Guantanamo, and was invited to be a visiting professional at the International Criminal Court at The Hague focusing on reparations for victims of war crimes. Recently, Gorman’s focus has shifted to suing the city of Chicago and several detectives for a wrongful incarceration case on behalf of Nathson Fields, a man who had been sentenced to death and spent 18 years in prison and on death row for a crime he did not commit.

Melinda Power: Melinda Power of the West Town Law Office practices criminal defense, civil rights, domestic relations, and works especially closely with the Puerto Rican community and on false arrests and police accountability. Her commitment to movement lawyering has seen her represent Puerto Rican independence activists, anti-Gulf War and anti-NATO demonstrators, striking workers, radical feminists, Black Lives Matter activists, and Standing Rock Water Protectors among others. Melinda has been an NLG member for over 40 years.

Announcements

Fall 2021 Exams: For more information about exams this semester, please visit the following links:

Fall Clothing Drive, now through 12/4/2021: Parents and Caregivers at Chicago-Kent (PACCK), The Chicago-Kent Racial Equity and Advocacy Alliance (REAA), and Women in Law (WIL)—in partnership with the Design Museum of Chicago—are pleased to sponsor a Fall Clothing and Toy Drive to benefit The Women’s Treatment Center (TWTC) in Chicago. The Design Museum will accept donations now through December 4, 2021. You may donate via drop-off, delivery, or mail, directly to:

Fall Bash: SBA will be hosting a Fall Bash on Friday, November 12 from 6-9 PM at The Atrium, a private event space above Tree House in River North (149 W Kinzie St)! The evening will include an open bar for 3 hours including bar service and table service, and food will be available for purchase.

In order to ensure covid safety, a few additional precautions are in place. Weather permitting, the retractable roof will be kept open for air flow, so dress warmly! We will be capping the event at 65% capacity, there are two different bar spaces, and servers will also come around to take orders, all to allow for social distancing and avoid bunching at the bar. In addition, IDs and vaccine cards/photos will be checked at the door, so please bring in addition to your student ID. Masks will be required for entry and when ordering at the bar, and strongly encouraged when not actively eating or drinking. Finally, we are limiting attendance to one guest per student.

Please sign up and pay here by November 10: $25 for students with Chicago-Kent ID and $45 for guests. Only the first 300 students will get the SBA-subsidized rate, and space is very limited beyond that, so sign up quickly!

SELS is organizing teams to compete in three sports competitions held at Tulane Law School next semester. These competitions are a nice mixture of moot court/trial team meets the world of sports statistics. For anyone interested in sports negotiations and sharpening your oral and written advocacy skills, these competitions may interest you! There is the International Baseball Arbitration Competition (January 19-21), the Football Negotiation Competition (February 3-5), and the Basketball Negotiation Competition. Each of these are anticipated to be held in person at Tulane in New Orleans. Space is very limited, so those interested should email SELS by Wednesday 11/17 and indicate which competition(s) you are applying for. Also include a short blurb of what qualifications, skills, and attributes you have that would make you a great addition to one of these teams. See below for specific information for each competition. Good luck!
