Prof. Subotnik argues that the Affirmative Consent standard that is advocated by some jurisdictions is a very dangerous standard to follow, and may not help to solve the typical “he said, she said” situation in most rape cases. He puts this view into perspective by taking a look into the recent Duke rape case as well. This topic should be very interesting, considering the substantial split between states on the applicable standard to use in rape law.
