Prof. Patrick Garry of the University of South Dakota School of Law will join us to discuss the thesis of his book, “Limited Government and the Bill of Rights.” In it, Prof. Garry proposes a new model for the Bill of Rights in general and the First Amendment in particular. He argues that the primary focus of the Bill of Rights was not to ensure personal autonomy or the protection of individual natural rights, but to provide additional safeguards for limited government. The book uses a limited government model to explain the meaning and purpose of the Bill of Rights, and also argues that such a model has already been implicitly put into effect by the Court.
Prof. Heyman, who has his own views on the subject, will give brief commentary at the end.
